Privacy Policy

Aerialink Inc., with registered offices at 100 Somerset Corporate Blvd., Bridgewater, NJ 08807 (“Aerialink”), is the responsible entity and has published the following Privacy Policy to describe how Aerialink uses information it collects when people visit any of Aerialink’s websites (the “Website(s)”), visit any of Aerialink’s physical offices or datacenters (the “Office”), or sign up to use any of Aerialink’s services (the “Service”).


Our commitment to protecting your privacy

Aerialink is committed to all aspects of protecting your privacy. We promise that we will use your personal or business information that you provide only in a manner that is compatible with this Privacy Policy. These policies are in effect for all services that Aerialink provides, including the Aerialink products and services platform, web pages, newsletters, discussion lists, announcement lists, and any other content or intellectual property that is owned and operated by Aerialink. What information does Aerialink collect?

When you use the Websites or sign up for any Service, we may collect certain contact information from you, including, but not limited to: first and last name, company, organization or entity name, city, state and postal/zip code, email address, and phone number. These information items are collectively referred to as, “Account and Contact Information.”

When purchasing any Aerialink Services, you will be required to provide additional information to facilitate the billing and payment collection process. These details may include a credit card number with its associated billing name and address or other bankcard or account information. These information items are collectively referred to as, “Billing Information.”

Every computer connected to the Internet is given a domain name and IP address – a set of numbers that serve as that computer’s “Internet Protocol Address.” When a visitor utilizing a browser or an application requests a page or resource from the Website or Services, our web servers and applications automatically recognize that visitor’s domain name and IP address. The domain name and IP address reveal nothing personal about you other than the IP address from which you have accessed our Website or Services. As with any standard website, Aerialink will receive and may record this information obtained from your browser or application session with our Websites or with our web-accessible services to our web-and-application-server logs or database. This specific and publicly available information we may record includes your local computer or server domain and IP address, your account login information, the Website pages you request through your browser or web application, and the date and time in which you requested them. We use and may record this information to examine our traffic in aggregate, but we do not collect and evaluate this information for specific individuals except for the purposes of authenticating application requests to our Services or Resources in order to protect and keep your accounts secure. Our web servers and applications do not record e-mail addresses of the visitors unless specifically provided by the user at their control and discretion. In conjunction with “Website Information” as described above, Aerialink may occasionally send a “cookie” to your computer following a visit to one of our Websites or application Services. A cookie is a small piece of data that is sent to your browser from a web server and stored on your computer’s hard drive. A cookie cannot read data off your hard disk or read cookie files created by other sites. Cookies do not damage your system. We use cookies to maintain browser or client session connections to our Websites and Services, which may be required for them to function properly. We use cookies to identify which areas of the Website you have visited, so that those pages may be readily accessible the next time you visit. In connection with your use of the Services, Aerialink may collect information that is created or provided by you for the purpose of delivering such Service. This information may include Personally Identifiable Data and may include Service-specific content such as landline telephone numbers, wireless mobile numbers, telecommunication carrier special communication numbers, common short codes, registered carrier long codes, or content which may include, but is not limited to; text messages, videos, pictures, audio recordings, or website pages or links. These information items are collectively referred to as, “Service Information.”

All information described above—“Account and Contact Information”, “Billing Information”, “Website Information,” “Browser Information and Cookies,” and “Service Information”—may be referred to, collectively, as the “Data.” The term “Personally Identifiable” refers to any Data, information, or content, which directly, or when used in conjunction with other provided information, will enable the identification of a specific individual.

Further, in order to subscribe to the message transmission Service offered by Aerialink, we require that you provide us with certain Personally Identifiable information (please see our Terms of Service for additional details). The types of Personally Identifiable information that may be collected by Aerialink through the Website include, without limitation: name, address, e-mail address, cell phone number and MSISDN (Mobile Station Integrated Services Digital Network Number), credit card and billing information, download history, SMS and MMS messages, your generated content and/or information about your interests in and use of various products, programs, and services. Aerialink will not collect any Personally Identifiable information about you unless you provide it to us voluntarily.

You retain ownership of any information you include in your account and contact lists in order to identify recipients of your messages that you initiate through the Service, Aerialink will not use contact lists for its own promotional campaigns or sell contact lists to third-parties, subject at all times to Aerialink’s need to access and use such information in order to provide the Service pursuant to its Terms of Service and this Privacy Policy.

We may occasionally use such Personally Identifiable information to provide the Service that you have requested, to contact you about programs, products, features or services in which we believe you may be interested (such as future promotional materials), or for other purposes disclosed. We also may use your Personally Identifiable information to contact you regarding your use of our Website or changes to our Privacy Policy, Terms of Service, or other policies or terms that affect you and your use of our Website and Services. In addition, we may use information collected about our users to improve the content and navigation of our Website, or for other internal purposes.

To fulfill your requests for products and services, we may share the Personally Identifiable information you provide with your cell phone service provider or their partner and subcontractor companies. This Privacy Policy does not cover such entities’ use of information. To learn more about your provider’s privacy practices, you should consult its privacy policy.

Further, if you use a third-party application or service that is integrated with Aerialink, such third party’s privacy policy will govern the use, storage and disclosure of your data in connection with that application or service.


What other information do you request?

We may ask you to provide your e-mail address or mailing address for the purposes of communicating service alerts and announcements, or to provide additional services (e-mail newsletters, surveys, announcement lists, information about new services). Whenever we request the identity of a visitor, we will clearly indicate the purpose of the inquiry before the information is requested. We maintain a strict “No-Spam” policy, which means that we do not intend to sell, rent, or otherwise give your e-mail address to a third party.

In addition, Aerialink will not send you e-mail that you have not agreed to receive. We may, from time to time, send e-mail announcing new services offered by Aerialink.

When you sign up for an Aerialink service or newsletter, your name or alias is recorded solely for purposes of maintaining your account within the Aerialink client database or as a subscriber to any future newsletters or other related content.

Our Website is not directed at individuals of fewer than thirteen (13) years of age, and Aerialink does not intend to collect any Personally Identifiable information from such individuals unless otherwise stated at the time such information is collected.


What information is disclosed to outside third parties?

Aerialink will disclose personal information when required by law or in the good-faith belief that such action is necessary to:

– Conform to the edicts of the law or comply with a legal process served on Aerialink.
– Protect and defend the rights or property of Aerialink and its network of sites, or visitors to Aerialink.
– Identify persons who may be violating the law, the legal notice, or the rights of third parties.

Aerialink uses reasonable precautions to keep the information disclosed to us secure. Aerialink reserves the right to transfer information in connection with the sale of all or part of Aerialink capital stock or assets, or other corporate change respecting Aerialink, the Website and/or the Services offered thereby. Furthermore, we are not responsible for any breach of security or for any actions of any third parties who receive the information.


What else should I know about my privacy when online?

Our Website contains many links to other websites. Aerialink is not responsible for the privacy practices or the content of such websites. Aerialink does not share any of the individual personal information you provide with the sites to which Aerialink links unless one of those sites belongs to a third party who falls under the aforementioned criteria. Please refer to those sites for their privacy policy.

Please keep in mind that whenever you voluntarily disclose personal information online (e.g. via e-mail, discussion lists, et cetera) that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.

If you are visiting the Website from outside the United States, please be advised that your personal data will be processed by Aerialink in the United States where data protection and privacy regulations may differ from similar regulations in other countries. By using the Website, you consent to any such transfer of information outside of your country if you are located outside of the United States.
